Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SpyShrimp website and application (collectively, the "Services") provided by SpyShrimp ("SpyShrimp," "we," "us," or "our"). By creating an account or using the Services, you agree to be bound by these Terms. If you use the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Accounts and Eligibility

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date.

Subscriptions, Billing, and Cancellation

SpyShrimp offers a free plan and paid subscription plans. The features and limits of each plan are described on our pricing page. Paid plans renew automatically at the end of each billing period (monthly or annual, depending on your selection) unless you cancel before the renewal date. You can cancel at any time from your account settings; your access to paid features continues until the end of the current billing period.

Prices are stated in U.S. dollars and are subject to applicable taxes. We may change our prices with reasonable advance notice; any price change applies to subsequent billing periods. Payments are handled by our third-party payment processor, and we do not store your full payment card details. Except where required by law, fees already paid are non-refundable.

Acceptable Use

SpyShrimp analyzes publicly available Instagram content. When using the Services, you agree that you will not:

• Use the Services to access, collect, or attempt to access any private account, private content, or data that is not publicly available
• Use the Services in any way that violates Instagram's terms or Meta's platform policies, including automated activity performed directly on Instagram
• Use the Services for harassment, stalking, surveillance, or any purpose that violates the privacy or rights of others
• Resell, redistribute, or provide access to the Services to third parties without our written consent
• Scrape, crawl, or extract data from the Services other than through features we explicitly provide, such as CSV export
• Attempt to gain unauthorized access to the Services, other accounts, or our systems, or interfere with the proper working of the Services
• Use the Services to violate any applicable law or regulation

We reserve the right to suspend or terminate your account if you violate these Terms or if your use of the Services creates risk or legal exposure for us.

Intellectual Property

The Services, including all software, designs, text, graphics, and logos, are owned by SpyShrimp and protected by intellectual property laws. Content from third-party Instagram accounts that is displayed through the Services remains the property of its respective owners and is provided for informational and research purposes only. You may not republish or commercially exploit third-party content beyond the analysis features the Services provide.

You retain all rights to the content and data you submit to the Services, such as the competitor accounts you track and the notes or exports you create. You grant us a limited license to process that data solely as necessary to provide the Services to you.

Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or that any particular content strategy or business outcome will result from using the Services. Metrics and insights are based on publicly available data and may be incomplete, delayed, or inaccurate.

To the maximum extent permitted by law, SpyShrimp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or relating to your use of the Services. Our total aggregate liability for any claim relating to the Services is limited to the amount you paid us in the twelve months preceding the claim.

Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Services ceases immediately, and sections of these Terms that should survive termination will survive.

Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by updating the "Last updated" date at the top of this page. Material changes will be communicated reasonably in advance, and continued use of the Services after the changes take effect indicates acceptance of the updated Terms.
